These Terms of Service (“Terms”) govern your use of ERMoto.co (the “Website”) and your purchase of products from ER Moto (“ER Moto,” “we,” “us,” or “our”).
By accessing or using the Website, creating an account, placing an order, or purchasing a product from ER Moto, you agree to these Terms and our other applicable policies, including our Privacy Policy, Shipping Policy, and Return & Refund Policy.
If you do not agree with these Terms, please do not use the Website or purchase products from us.
1. Eligibility
You must have the legal capacity to enter into a binding agreement in your jurisdiction to place an order through the Website.

ER Moto sells electric motorcycle, dirt bike, powersports, and related replacement, upgrade, and accessory products.

Unless expressly stated otherwise, ER Moto is an independent business and is not affiliated with, sponsored by, endorsed by, or officially associated with any third-party vehicle manufacturer or brand referenced on the Website.

4. Orders
When you place an order through the Website, you are submitting an offer to purchase the products in your order.
After placing an order, you will generally receive an order confirmation by email. An order confirmation does not necessarily mean that ER Moto has accepted the order or that the order cannot subsequently be canceled for a legitimate reason.
ER Moto reserves the right to refuse or cancel an order when permitted by law, including in circumstances involving:

Once an order has been shipped, delays may occur due to carriers, weather, customs, incorrect addresses, holidays, or other circumstances outside ER Moto's reasonable control.

8. Returns and Refunds

We may request photographs, videos, installation information, order information, or other documentation necessary to evaluate the issue.
If a product is determined to be defective or otherwise covered by an applicable warranty or legal protection, ER Moto will provide the remedy required by the applicable law or the applicable product warranty, which may include repair, replacement, refund, or another appropriate remedy.
Nothing in these Terms limits rights that cannot legally be excluded.
10. Product Installation and Use
Many ER Moto products are mechanical, electrical, or vehicle-related components.
Customers are responsible for proper installation and use of products purchased from ER Moto.
Products should be installed by a person with appropriate knowledge and experience. Follow applicable manufacturer instructions and use appropriate safety equipment and procedures when installing or working on a vehicle.
ER Moto is not responsible for damage resulting from improper installation, incorrect assembly, modification, abuse, neglect, misuse, or use outside the intended application, except to the extent liability cannot legally be excluded.
11. Off-Road and Competition Products
Certain products may be designed or marketed for off-road, recreational, closed-course, or competition use.
The legality of modifying or operating a vehicle varies by jurisdiction.
You are responsible for determining whether your vehicle and its modifications comply with all applicable federal, state, and local laws, including requirements concerning registration, inspection, equipment, emissions, noise, and operation on public roads.
ER Moto does not represent that every product sold through the Website is legal for street use in every jurisdiction.
